AFGHANISTAN INVESTIGATION REFERRED TO THE

DIRECTOR OF MILITARY PROSECUTIONS


On 12 February 2009 five Afghan civilians were killed and four injured in an incident

involving Australian troops in Afghanistan.  A suspected insurgent was also killed in

the incident.  This incident was previously advised to the Australian public through a

press briefing and media release on 13 February 2009.


An Inquiry Officer was appointed to conduct an inquiry into this incident.  As a result

of this initial inquiry the matter was referred to the Australian Defence Force

Investigative Service (ADFIS) in July 2009.  The ADFIS investigation was recently

completed and the brief of evidence has now been referred to the Director of Military

Prosecutions.


As this matter is now subject to consideration by the Director of Military Prosecutions

no further comment can be made at this time.


Once the Director of Military Prosecutions has determined the way ahead the

Australian public will be informed.
